Sen. Josh Hawley said he will try to censure Senate Minority Leader Chuck Schumer for threatening that two conservative justices hearing an abortion case would “pay the price” if they voted to restrict reproductive rights.
“I would call on Schumer to apologize, but we all know he has no shame,” Hawley (R-Mo.) wrote in a Wednesday night tweet. “So tomorrow I will introduce a motion to censure Schumer for his pathetic attempt at intimidation” of the Supreme Court.
Schumer (D-NY) made the threatening comments against Justices Neil Gorsuch and Brett Kavanaugh at a rally on the steps outside the high court.
“I want to tell you Gorsuch, I want to tell you Kavanaugh, you have released the whirlwind, and you will pay the price,” he said.
The court was hearing a challenge to a Louisiana state law that required doctors who perform abortions to have admitting privileges at a hospital within 30 miles of the clinic. Opponents said the law would limit women’s access to abortion in the state.
Schumer’s comments were met with a rare public rebuke by Chief Justice John Roberts, who denounced the remarks wholeheartedly.
“Senator Schumer referred to two members of the Supreme Court by name and said he wanted to tell them that ‘You have released the whirlwind and you will pay the price. You will not know what hit you if you go forward with these awful decisions,” Roberts said in the statement.
“Justices know that criticism comes with the territory, but threatening statements of this sort from the highest levels of government are not only inappropriate, they are dangers. All Members of the Court will continue to do their jobs without fear or favor, from whatever quarter,” he added.
Schumer has since aimed to walk back his words, and place blame on President Trump and the right-wing media.
“Sen. Schumer’s comments were a reference to the political price Senate Republicans will pay for putting these justices on the court, and a warning that the justices will unleash a major grassroots movement on the issue of reproductive rights against the decision,” a spokesman for Schumer said in a statement late Wedneday.
“For Justice Roberts to follow the right wing’s deliberate misinterpretation of what Sen. Schumer said, while remaining silent when President Trump attacked Justices Sotomayor and Ginsberg last week, shows Justice Roberts does not just call balls and strikes.”
